Registration of Divorce

Divorce is the ground for termination of marriage between spouses.

Application for registration of divorce may be filed at the territorial office of the Public Service Development Agency or Public Service Hall branch.  

An application for divorce may be filed by one of the spouses, if:  

•           A court judgement on divorce is available;  

•           The other spouse is recognised by the court as missing;

•           The other spouse has been sentenced to at least 3 years of imprisonment for committing a crime:

o          Registration of divorcing the convicted spouse shall be conducted if there is no dispute between the spouses regarding the division of their common co-ownership, payment of alimony in favour of an incapacitated spouse, or with respect to children they have in common.

o          In order to verify the absence of the grounds for refusing to register divorce from the convicted spouse, the convicted spouse shall be notified about submission of the application for divorce and a reasonable period for submitting a written reply shall be defined.

o          The period for submitting a reply must not exceed 1 month from the day of notification if the convicted spouse is serving the sentence in Georgia. If the convicted spouse is in prison of other country, the period specified above must not exceed 6 months from the day of notification.

o          If the convicted spouse declares that there is no dispute between the spouses or fails to submit a written reply within the determined period, the divorce shall be registered.  

o          Divorce shall be registered within two days from receipt of the reply of the convicted spouse, or expiration of the 1-month term. 

Documents required for registration of divorce based on a joint application of spouses:   

•           A joint written application of spouses; 

•           Identity documents of both spouses;  

•           Marriage certificate.   

Documents to be submitted for registration of divorce via representative:    

•           Power of attorney (duly certified); 

•           Identity document (identity card or passport) of representative. 

Terms and fees   

•           Divorce shall be registered after 5 working days from filing of the application; 

•           The fee for registration of divorce and issuance of certificate is GEL 60.
